ON THE PROPOSED PROVINCIAL ORDINANCE NO. 21-2009 “AN ORDINANCE IMPOSING CURFEW HOURS ON TRAVEL OF MOTORCYCLES FROM 11:00PM TO 3:00AM WITHIN THE PROVINCE OF PANGASINAN”
We, the officers and members of Pangasinan Bikers Federation, Inc., a duly registered federation of motorcycle clubs in the province of Pangasinan, STRONGLY OPPOSE, the proposed Provincial Ordinance No. 21-2009, otherwise known as “Curfew Ordinance on Travel of Motorcycles for the Province of Pangasinan.”
We are OPPOSING this proposal for the following reasons:
1. The proposed ordinance is selective and discriminatory to motorcycle users. It impose curfew to motorcycle while ignoring the fact that other means of transportation such as car, jeep and van can also be used by criminals;
2. We do not believe that imposition of curfew hours will eradicate the incidence of killings and other criminalities in the province. Criminality itself does not impose its own time; it strikes anytime of the day it wants. Based on our experience in our respective communities, the most effective way of eradicating criminalities is the heightened and intensified campaign by our law enforcers and with the active participation of our local constituents. Specifically, we propose an intensified “Operation Bakal” to be conducted by our local police force;
3. The exemption provision “for medical and/or emergency purposes” is synonymous to no exemption at all because it sets a limit for the use of a motorcycle under a very risky and impossible situation. Indeed, we cannot imagine how one can avoid the risk and make it possible to use a motorcycle to bring a patient in a hospital under emergency situation. On the other hand, this exemption provision utterly disregards the rights and welfare of the riding public whose only means of transportation is the motorcycle. It disregards the rights and freedom of motorcycle users who are working during night time and those using motorcycles with other legitimate reasons. It also denies the rights and convenience of motorcycle users outside of Pangasinan whose only route is to pass through our province;
4. The penalties it imposes are too burdensome for an ordinary motorcycle user. Sadly, such penalties can also be the cause of untoward corruption which could easily be initiated by the apprehended who wants to get rid of actual penalty; and
5. The imposition of curfew will definitely send a wrong signal to our investment and tourism industry. An imposed curfew will send an alarming peace and order situation in the province and would therefore drive away investment and tourism opportunities.
We therefore urge the Sangguniang Panlalawigan of Pangasinan to heed our call for the rejection of said proposed ordinance; even as we assure our Provincial Leadership of our full cooperation and participation in the promotion of peace and order in the province.
